Rent indexation in Flanders

In the Flemish Region, the decree of 3 October 2022 applies a permanent EPC correction factor to leases predating 1 October 2022 (EPC D, E, F or no EPC). More recent leases are indexed at 100%, whatever the class.

In short: in Flanders, indexation is annual, on the anniversary of the lease taking effect. For leases predating 1 October 2022, a permanent correction factor reduces the indexed rent: roughly × 0.95–0.98 for EPC D, × 0.89–0.96 for EPC E, F or no EPC, depending on the anniversary month. EPC A, B, C and all leases that entered into force since 1 October 2022: indexation at 100%.

The Flemish legal framework

2022-2023: a temporary limitation first

Like Wallonia and Brussels, Flanders limited the indexation of the least energy-efficient dwellings from October 2022, to cushion the impact of inflation on tenants. From 1 October 2022 to 30 September 2023 (decree of 3 October 2022), an EPC D dwelling could pass on only half of the increase, and a dwelling with EPC E, F or no valid EPC none of it.

Since 1 October 2023: the correction factor

The same decree of 3 October 2022 (article 4, in force since 1 October 2023) sets the current regime: indexation is possible again for all dwellings, but leases that took effect before 1 October 2022 with an EPC D, E, F or no EPC are subject to a correction factor. This factor permanently neutralises the increase that could not be applied during the temporary phase: it is fixed once and for all per anniversary month and applies to every future indexation of the lease. Label G does not exist in the Flemish EPC. Contracts taking effect from 1/10/2022: 100% all classes.

The factor multiplies the rent obtained with the standard formula. It depends on two things: the EPC class (D on one side; E, F or no EPC on the other) and the anniversary month of the lease. Flemish specifics: label G does not exist, and no certificate is required to index — but without an EPC, the strongest reduction factor (that of classes E-F) applies. The factor stops applying as soon as the landlord obtains a new EPC A+, A, B or C; moving from E-F up to D switches to the D factor.

Worked example

Flemish lease that took effect on 1 September 2022, rent €950, EPC E, indexation on 1 September 2026:
Health index August 2022: 123.68 — Health index August 2026: 140.30 (2013 base)
Standard formula: 950 × 140.30 / 123.68 = €1,077.66
EPC E correction factor, September anniversary: × 0.9601
Indexed rent = 1,077.66 × 0.9601 = €1,034.66 (€43 per month less than without the factor)

For French-speaking owners of a property in Flanders

If you own a property in the Flemish Region but reside in Wallonia or Brussels, several points to keep in mind:

  • Flemish administrations operate in Dutch: draft the lease contract in Dutch, or have it translated, to avoid any dispute
  • The same goes for the indexation notification to the tenant
  • Lease registration is performed at the registration office of the location of the property (i.e. in Flanders)
  • The calculator remains valid: the formula is national; only the EPC correction factor is regional

Frequently asked questions — Flanders

Why is the EPC factor permanent in Flanders?
+ −

The Flemish decree of 3 October 2022 applies a correction factor to leases that took effect before 1 October 2022 when the dwelling has an EPC D, E, F or no EPC. This factor, set per anniversary month of the lease, applies to every indexation: it has no end date.

What is the difference between EPC and PEB?
+ −

Mostly the wording: PEB (Performance Énergétique du Bâtiment) in French, EPC (EnergiePrestatieCertificaat) in Dutch. Note that the scales are not identical — label G does not exist in the Flemish EPC.

My Flemish lease dates from 2024 with EPC E: can I apply indexation?
+ −

Yes, at 100%. The correction factor only targets leases that took effect before 1 October 2022. A 2024 lease is indexed with the standard formula, whatever the EPC class.

I am a French-speaking owner of a property in Flanders — where should I start?
+ −

Flemish administrations operate in Dutch: draft the lease and the notifications in Dutch, or have them translated, to avoid any dispute. The calculation remains based on the single Belgian health index — the formula is identical.

Does the calculator work for Flanders?
+ −

Yes — select 'Vlaanderen' in the region selector. The correction factor is applied automatically according to the EPC class and the lease date.

What if I have no EPC?
+ −

In Flanders, no certificate is required to apply indexation. For a lease predating 1 October 2022 with no EPC, the factor for classes E-F (the strongest reduction) applies. Having an EPC issued — valid for 10 years — can therefore pay off if the dwelling scores better.
