Brussels: an EPC factor still active for older leases

Since 14 October 2023, Brussels has applied a correction factor, with no end date, to leases that entered into force before 14 October 2022 where the property is rated EPC E, F or G. The factor multiplies the full result of the ordinary formula (not just the increase). For those leases, the calculation is:

Indexed rent = Base rent × (New index ÷ Starting index) × Correction factor

In Brussels, the starting index is that of the month before the signature of the lease; the new index is that of the month before the anniversary of its entry into force. To index, the lease must be registered and an EPC certificate must have been provided to the tenant — otherwise no indexation is due.

Leases taking effect from 14/10/2022: 100% all classes. A registered lease and a valid EPB certificate provided to the tenant are required to index. Different percentages applied during the 2022-23 window.

The factor also varies with the anniversary month of the lease's entry into force (October is split: 1 to 13 and 14 to 31). Our calculator automatically applies the correct value — no need to compute it manually.

Which legal framework?

  • Ordinance of 13 October 2022 (Brussels-Capital Region, published and in force on 14 October 2022): temporary limitation of indexation from 14 October 2022 to 13 October 2023
  • Ordinance of 13 October 2023 (in force since 14 October 2023): current correction factor — Brussels Housing Code, art. 224/2 § 1/2
  • Official be.brussels page: rent indexation with correction factor (table of factors, in French)
  • Law of 6 August 1993 and Royal Decree of 24 December 1993: federal framework for indexed rents

How to find your EPC?

The EPC certificate is mandatory for rentals in Brussels. If you don't have it:

  • Check your lease (often annexed)
  • Request it from the certified assessor who issued it (10-year validity)
  • Check the database of Brussels Environment

Frequently asked questions — Brussels

Does the EPC apply to my Brussels lease?
+ −

The EPC correction factor only applies if your lease entered into force before 14 October 2022 and the property is rated E, F or G. For leases that entered into force from 14 October 2022 onwards, and for EPC A to D, indexation follows the ordinary formula at 100 %. In all cases, a registered lease and an EPC certificate provided to the tenant are required in order to index.

What are the EPC coefficients in Brussels?
+ −

Under art. 224/2 § 1/2 of the Brussels Housing Code, for leases that entered into force before 14 October 2022: EPC A to D: 100 %; EPC E: correction factor of roughly 0.945 to 0.990; EPC F-G: roughly 0.891 to 0.980. The factor depends on the anniversary month of the entry into force and multiplies the full indexed rent.

My Brussels lease dates from June 2021 with EPC G: am I entitled to index?
+ −

Yes, provided the lease is registered and the EPC certificate has been provided to the tenant. As the lease entered into force before 14 October 2022, the indexed rent is multiplied by the F-G correction factor (0.944248135 for a June anniversary). It was during the temporary period from 14 October 2022 to 13 October 2023 that no indexation was allowed for EPC F and G.

Does an unknown EPC equal 0 %?
+ −

In Brussels, without a valid EPC certificate provided to the tenant, no indexation is due — whatever the date of the lease. An EPC certificate must be issued and provided to the tenant in order to index.

What if the tenant disputes the calculation?
+ −

The calculation applying the legal formula and official Statbel indexes is technically opposable. In case of persistent disagreement, the justice of the peace decides upon simple petition (low-cost procedure, no lawyer required). Our notification PDF provides all the proof elements (formula, indexes, sources) needed in case of dispute.
